McIlwain Law Litigation Team
The litigation team at McIlwain Law brings together counsel with experience in many areas of the law from civil rights to personal injury, corporate and more.
TIMOTHY J. MCILWAIN, ESQUIRE
Timothy McIlwain left Atlantic City High School in New Jersey to study political economies at University of California, Berkeley. After graduating in 1991, he was the recipient of the prestigious Martin Blatt Law Scholarship and returned to the east coast to obtain his juris doctorate from New York Law School in 1995. He was admitted in 1996 to New Jersey and United States District Court. He is an accomplished trial attorney, and the only New Jersey lawyer admitted to Gerry Spence’s prestigious Trial Lawyers College, where he spent a month in a Wyoming barn practicing jury trial methods with the country’s best.
Attorney McIlwain’s competitive spirit as a former high school and college quarterback translated well in the courtroom, where his numerous successful jury trial results led to him being certified in 2014 as a lifetime member of both the Million Dollar Advocates Forum and the Multi-Million Dollar Advocates Forum, two of the most prestigious groups of trial lawyers in the country. Membership is limited to attorneys who have demonstrated exceptional skill, experience, and excellence in trial advocacy and have obtained recoveries on behalf of their clients in excess of $2 million. There are less than 30 attorneys in New Jersey with this distinction.
Attorney McIlwain is well-versed in entertainment and sports law, as well as business disputes, right of privacy, employment and personal injury. He has successfully represented a variety of celebrities in cases involving sexual harassment and discrimination, wrongful termination, and contract disputes. Mr. McIlwain helped change sports medicine forever by defeating major corporations like Comcast and the Philadelphia Flyers, resulting in a multimillion dollar verdict.
He has successfully defended Hall of Famer Jim Brown and sued former heavy weight boxing champions, and the World Hockey Association. He has represented Donald Trump’s Casinos and served as Walmart’s exclusive counsel on work related injuries. Mr. McIlwain’s experience is drawn from his involvement in and around sports, both as a player at the collegiate level and as agent for professional athletes.
BENJAMIN B. BRENNER, ESQUIRE
BENJAMIN B. BRENNER obtained his juris doctorate from Atlanta’s John Marshall Law School in 2010. He has extensive experience in many areas of the law including civil litigation for employment, civil rights, education law, municipal government law, labor law and corporate law. He has represented clients in administrative proceedings, mediations and arbitrations, and tenure hearings, and has also assisted in labor contract negotiations. Benny’s professional experience prior to law spans from firefighting to restaurant management, bringing a unique expertise to the team and an ability to see issues from the client’s perspective.
DOUG ARNOLD, ESQUIRE
Esquire and equestrian Doug Arnold comes from a long line of Kentuckians. Doug graduated from Centre College in 2008 with a degree in history and got his Juris Doctorate from University of Kentucky College of Law in 2014, passing the Kentucky bar exam in 2015. In addition to practicing law and true to his Kentucky roots, Douglas deals in horses as a Thoroughbred Bloodstock agent. He rounds out the team with southern flair and sensibility.
JOSHUA KRICKER, ESQUIRE
We are lucky to have retired attorney Joshua Kricker on board for litigation support in legal research, writing and private investigation. His extensive expertise ranges from medical malpractice and personal injury to wrongful discharge, wrongful death, family law, trademark and anti-trust. Joshua Kricker obtained his juris doctorate from Antioch School of Law. He holds a bachelor’s degree in political science, with a minor in sociology, from Southern Connecticut State University. Joshua has conducted dozens of major felony trials and appeals. Notable accomplishments include obtaining acquittal in landmark felony case (State v. Elijah Rose), and obtaining judgment of acquittal from the court in a criminal case without it being submitted to the jury (State v. William Gelormino). Prior to that time, no judgment of acquittal had been granted in that judicial district in four years. Joshua is an unparalleled researcher and has a special talent in locating witnesses and other critical and not easily obtained evidence.
